$1,041,000 for Woman Severely Injured in a Truck Accident

On February 8, 2014, our client was driving her semi-tractor westbound on I-80 near Joliet, Illinois in snowy and icy road conditions. Our client stopped her vehicle in the middle of the roadway as there was a car spinning out in front of her.  While stopped, she was rear ended by the Defendant driver, who was driving for a major trucking company.  The property damage on both semi-tractors was minimal.  Our client had $1,800 in repairs.  The defendants denied they were at fault stating our client made an emergency stop on the highway due to a car spinning out ahead of her.  The Defendants argued that the Defendant driver did not have enough time to stop.  The Defendants also filed a claim against the driver of the vehicle which was spinning out of control claiming she was responsible for the crash.

After the collision, our client was in pain and went to the emergency room the same night complaining of neck and back pain.  Our client had a longstanding history of prior neck and back pain as documented in her medical records.  As a result of the collision, her neck and back injuries were aggravated.  The severity of the aggravation necessitated neck and back surgery.  Because of our client’s prior complaints of neck and back pain, the Defendants claimed that all of our client’s injuries were preexisting and not related to the collision.  The Defendants’ opinion was backed by two Independent Medical Examinations stating our client was not injured as a result of the collision.  Our client’s treating physician, who performed her neck and back surgeries opined the crash aggravated her preexisting conditions.

Whiting Law Group hired a top Accident Reconstructionist out of Indiana to prove the Defendants were at fault on this case.  Whiting Law Group’s Accident Reconstructionist proved that had the Defendant driver followed the safety rules for a professional truck driver he would have had ample enough time to stop before rear ending our client. The Defendant driver admitted during his deposition that he agreed to follow the safety rules for a professional truck driver when operating his 85,000 pound truck.  This testimony was critical to winning our client’s case.  

Whiting Law Group also used timelines designed and prepared by our team of lawyers and medical illustrations to show our client’s prior injuries were worsened by the crash and how her surgeries were performed.  Medical illustrations are a great resource to demonstrate the difference in her prior neck and back conditions and the progression after the date of the crash proving that the truck aggravated her conditions.

After six doctor’s depositions, numerous witness depositions, and two mediations, the Plaintiff was able to reach a $1,041,000 settlement with the Defendants within 30 months of handling.
