$475,000 Recovery for a Woman Injured in a Collision with a Truck

In March 2001, Attorney Timothy M. Whiting won an out-of-court settlement in Rock County Circuit Court for $475,000 against a trucking company.

Joanne Lindaas, a 63-year-old woman, was involved in a trucking accident rear-ended by a truck at high speed. As a result of the collision, she sustained right-sided paralysis and injury to her spinal cord. She subsequently underwent surgery to repair the damaged disc in her neck, which resulted in permanent right-sided weakness and balance problems. Due to her injuries, she also will be unable to obtain gainful employment in the future.

Mr. Whiting was able to prove, as a result of the high impact and damage to the plaintiff’s vehicle, that the collision was the cause of her neck injury and permanent weakness and balance problems on her right side. The Defendants contended that the collision aggravated pre-existing injuries in her neck.

The parties reached a settlement after significant discovery and expert medical testimony on the issues of pre-existing injuries that may have resulted from the collision. It is believed that this is one of the highest settlements in Rock County of a case of its kind.
