$750,000 Settlement for the Wrongful Death of a 52 Year-Old Woman

In August of 2003, Attorney Timothy M. Whiting won an out-of-court settlement in Cook County Circuit Court for $750,000 against a physician, Yeong K. Kim, M.D., of Chicago in a wrongful death action.
The deceased, Cheryl Hilliard, age 52, died on October 16, 1998 as a result of an acute separation of the mitral valve of her heart. She died instantly. Hilliard was under the care of Dr. Kim in the month prior to her death for symptoms consistent with the separation of the mitral valve.
Although Cheryl Hilliard possessed the symptoms and fit the risk factors for separation of her mitral valve, Dr. Kim misdiagnosed her with asthma. She died leaving behind two adult daughters, Anna and Teresa.
An interesting note to this case was that three prior law firms rejected Ms. Hilliard’s case prior to Mr. Whiting and the Whiting Law Group filing and winning the case.
