$800,000 for Southern Illinois Man Killed in Trucking Accident
Mountain Township, Illinois – January 2017
Whiting Law Group won a major settlement of $800,000.00 on behalf of a Plaintiff who was killed in a truck crash in southern Illinois. After a tough flight on proving the truck driver’s fault, Timothy M. Whiting was able to secure justice the surviving adult children of the deceased victim.
On August 6, 2014, our client was driving her motor vehicle northbound on a two-lane U.S. Route 24 in Saline County. The Plaintiff alleged that the southbound semi-truck driven by the defendant driver and owned by a local trucking company, suddenly moved into her lane of travel to avoid hitting a dog in the roadway. In order to avoid the collision, Whiting Law Group further alleged that our client moved into the southbound lane. At that point, the defendant semi-truck driver swerved back into his lane and collided head on with our client. The defense alleged the defendant semi-truck driver swerved to avoid hitting a dog, but that he never left his lane of travel and never crossed the center line before the crash.
Our client was killed instantly when her car was hit head on by the semi-tractor trailer driver. Despite being 6 hours from Chicago, Whiting Law Group’s emergency trucking accident response team was on the scene within 24 hours of the collision photographing the vehicles, measuring the roadway, interviewing police and witnesses, obtaining physical evidence from the scene, and obtaining skid marks from the collision before they washed away from the rain. Inspecting the scene of the collision is one of the most critical parts of any trucking case. Whiting Law Group and its emergency trucking accident response team is equipped to be on the scene of the collision within 24 hours of the collision occurring.
The physical evidence Whiting Law Group obtained from its emergency trucking accident response team in this case was critical. The roadway markings indicated that the defendant semi-truck driver was lying about never crossing the center lane. Our emergency trucking accident response team opined that the physical evidence showed the defendant semi-truck driver well into our client’s lane moments before the collision. Without investigating the scene immediately, we would have lost valuable evidence that was key to proving our case.
Our client was survived by her two adult children, one of whom tragically passed away in a semi-truck collision a month after our client passed. The passing of our client’s son at the beginning of the case limited her family’s recovery. Despite this setback, Whiting Law Group was able to obtain $800,000.00 of the $1 Million policy from Nationwide Insurance.
With a success rate of 96%, the personal injury and truck accident attorneys at Whiting Law Group worked tirelessly to secure justice for our client’s children. In just two years from the date of the crash, Whiting Law Group won an $800,000.00 settlement for our client’s family.
The firm has also won numerous cases that were either settled or tried before a jury and resulted in millions of dollars in recovery for the firm’s clients over the past 15 years.
