Faulty Maintenance Caused a Deadly Truck Crash
On March 11, 2014, the Plaintiff, William Rigsby, was driving his semi-tractor trailer southbound on Highway 45 near Omaha Township, in southern Illinois. As he drove along Rte. 45, Mr. Rigsby was forced suddenly to swerve off the road when the inner tire of another tractor-trailer slammed into the side of his truck. That tire spun off the rear driver’s side trailer axle on the truck, driven by Defendant Thomas Woodworth. Mr. Woodworth’s truck was owned by Britton Trucking, Inc.
Mr. Rigsby was killed instantly when his tractor-trailer swerved off the road and hit a tree. Mr. Rigsby was survived by his wife, Jennifer Rigsby, 54. Mr. Rigsby was 61 at the time of his death.
During the course of discovery, Whiting Law Group determined that Mr. Woodworth and Britton Trucking, Inc., had failed to follow federally mandated rules on the proper inspection and maintenance of its truck, including the tires, rims and lug nuts. As a direct result of that failure to follow the safety regulations, Britton Trucking, Inc. allowed an unsafe truck onto the road. The result of the negligence of Mr. Woodworth and Britton Trucking, Inc., was the tragic death of the victim, Mr. Rigsby.
With a success rate of 96%, the personal injury and truck accident attorneys at Whiting Law Group worked tirelessly to secure justice for Mr. Rigsby’s widow. In just 18 months from the date of the crash, Whiting Law Group won a $1,000,000.00 settlement, which was the insurance policy limits for the defendant driver and trucking company.
The firm has also won numerous cases that were either settled or tried before a jury and resulted in millions of dollars in recovery for the firm’s clients over the past 15 years.
